Important service-payment rule
NBH Partners BPO sells professional, digital, operational, creative, technical, and educational services — not returnable retail goods. A payment reserves professional time, production capacity, specialist attention, systems, and/or delivery resources. Once work has started, the payment for that work is generally non-refundable, except to the extent a refund or withdrawal right is required by applicable law.
PaymentsDue before work unless agreed otherwise.
RefundsGenerally unavailable after work begins.
AccessClient must provide lawful, secure access.
ScopeOnly purchased or written scope is included.
SecurityNo system can be guaranteed invulnerable.
Third partiesExternal platform rules and outages apply.
1. Agreement and Order of Precedence
These Policies & Service Terms form part of every order placed through nbhpartnersbpo.com and every service engagement that expressly incorporates them. By ordering, paying for, authorising, or continuing a service, the customer confirms that they had a reasonable opportunity to review these terms.
If a signed proposal, statement of work, master services agreement, data-processing agreement, or other written contract expressly conflicts with this page, the signed document controls for that specific engagement. Mandatory law always takes priority where it cannot lawfully be excluded.
2. Payments, Service Commencement and Strict Refund Rules
2.1 Payment secures service capacity
Prices shown on the website apply only to the package and scope described at the time of purchase. Payment is due in advance unless NBH Partners BPO agrees otherwise in writing. Payment may reserve staff time, production capacity, onboarding capacity, licences, research time, configuration time, or a scheduled delivery window.
2.2 Non-refundable after work begins
Once NBH Partners BPO begins any part of the purchased service, the amount attributable to work commenced, work completed, capacity reserved, or non-recoverable costs incurred becomes non-refundable, except where applicable law requires otherwise.
For this purpose, “work begins” can include discovery, planning, research, project setup, account or environment preparation, design, development, coding, editing, testing, QA, configuration, documentation, data processing, operational activity, staff allocation, training, consultation, meetings, communications that materially advance the service, or procurement of client-specific third-party resources.
Evidence that work has begun may include project records, tickets, time records, system logs, code commits, drafts, design files, configuration history, communications, task assignments, access records, meeting records, or other reasonable evidence of performance.
2.3 Immediate commencement
Where checkout asks the customer to request immediate service commencement, the customer authorises NBH Partners BPO to begin before any statutory withdrawal period has expired. Where permitted by law, a withdrawal right may be reduced or lost after performance begins or is fully completed. If mandatory consumer law still permits withdrawal after work has begun, the customer may remain responsible for the proportion already performed.
2.4 Change of mind, internal approval, budget changes
A customer change of mind, internal management change, budget change, project reprioritisation, failure to obtain internal approval, or decision not to use delivered work does not create a refund right for work already begun, capacity already reserved, or non-recoverable costs already incurred.
2.5 Deposits, retainers and recurring capacity
Deposits, retainers, reservation fees, and recurring service fees are used to reserve delivery capacity. Once the relevant capacity has been reserved or the service period has started, unused capacity does not automatically roll over and is not refundable unless a written agreement states otherwise or mandatory law requires it.
2.6 Duplicate or incorrect charges
Verified duplicate charges or clear payment-processing errors will be corrected. Customers should report suspected billing errors promptly through the Contact page.
For additional detail, see the dedicated Refund & Cancellation Policy.
3. Scope, Revisions, Delivery and Acceptance
3.1 Scope is limited
The purchased package, written proposal, or agreed statement of work defines what is included. Anything not expressly included is out of scope. New pages, additional integrations, additional revisions, new content, new datasets, additional campaigns, additional workflows, expanded hours, extra users, new features, or materially changed instructions may require a separate quote or additional payment.
3.2 Revisions are not unlimited
Revisions are limited to the number and type included in the purchased package or written scope. A revision corrects or refines agreed work; it does not convert the engagement into a different project. New direction after approval, preference changes, or requests that reverse previously approved decisions may be treated as additional work.
3.3 Delivery depends on client cooperation
Timelines assume timely receipt of content, credentials, access, files, data, approvals, feedback, decisions, and other client dependencies. Client-caused delay automatically extends the practical delivery timetable and does not constitute non-delivery.
3.4 Acceptance and defect reporting
Customers should inspect deliverables promptly. Unless a written agreement provides a different acceptance period, objective defects or material deviations from the agreed scope should be reported in writing within seven calendar days after delivery or deployment. Silence does not waive rights that cannot legally be waived, but late preference changes, new requirements, or defects introduced by third-party updates or client changes may be treated as new work.
3.5 Project inactivity and abandonment
If the customer does not provide a required response, access, approval, or material for 14 consecutive days, NBH Partners BPO may pause the project. After 30 consecutive days of client inactivity, the project may be moved out of the active production schedule and may require rescheduling or a reactivation fee. Amounts attributable to work performed, capacity reserved, and non-recoverable costs remain payable and generally non-refundable.
4. Client Responsibilities
The customer is responsible for providing accurate instructions, lawful content, authorised access, timely approvals, and a competent contact person. The customer must verify important business, legal, financial, compliance, marketing, medical, tax, or regulatory decisions with an appropriately qualified professional where relevant.
The customer represents that it has the right to provide all data, trademarks, text, images, software, credentials, databases, customer lists, recordings, and other materials supplied to NBH Partners BPO. The customer must not instruct NBH Partners BPO to infringe third-party rights, violate platform rules, impersonate others, mislead users, or perform unlawful activity.
5. IT, Credentials, Access, Backups and Cybersecurity
5.1 Least-privilege access
Where technically possible, customers should provide role-based, temporary, or least-privilege access rather than master credentials. Customers should enable multi-factor authentication where supported and revoke unnecessary access after completion. NBH Partners BPO may refuse credentials or access arrangements that create unreasonable security risk.
5.2 Credential responsibility
Customers remain responsible for ownership and administration of their accounts, domains, hosting, cloud services, payment accounts, advertising accounts, email systems, source repositories, and other third-party platforms. NBH Partners BPO is not responsible for loss caused by credentials supplied incorrectly, credentials shared with unauthorised persons, compromised client devices, reused passwords, disabled security controls, or access changes made outside the agreed work.
5.3 Backups before technical changes
Unless backup services are expressly included, the customer is responsible for maintaining current, restorable backups before technical work is performed. NBH Partners BPO may create working backups where practical, but no backup process is guaranteed to capture every system state or third-party dependency.
5.4 Pre-existing technical conditions
Legacy code, unsupported software, malware, corrupted databases, undocumented customisations, incompatible plugins, expired licences, misconfigured servers, or pre-existing security weaknesses can materially affect technical work. Remediation of pre-existing issues is outside scope unless expressly included.
5.5 Security is risk reduction, not a guarantee
Reasonable security measures reduce risk but cannot make any website, application, network, account, cloud service, plugin, API, or human process completely invulnerable. NBH Partners BPO does not warrant that any system will be immune from hacking, malware, credential theft, zero-day vulnerabilities, denial-of-service attacks, third-party compromise, or future security defects.
5.6 Post-delivery updates
Software, browsers, operating systems, plugins, APIs, payment gateways, themes, hosting environments, security standards, and third-party platforms change over time. Unless maintenance is purchased, future compatibility work, updates, patches, migrations, or repairs caused by later changes are not included in the original delivery.
6. Data, Confidentiality and Sensitive Information
NBH Partners BPO will use reasonable organisational and technical care when handling client information required for the service. Customers should provide only information reasonably necessary for the engagement and should avoid transmitting passwords, payment-card data, government IDs, health data, highly sensitive personal data, or regulated datasets through ordinary email or website forms unless a suitable secure method and written scope have been agreed.
Where a project requires processing personal data on the customer’s behalf, the parties may need a separate data-processing agreement or security requirements appropriate to the data and applicable law. The customer is responsible for identifying regulatory, residency, retention, or industry-specific requirements before work begins.
Privacy information for website visitors is available in the Privacy Policy.
7. Intellectual Property, Licences and Third-Party Services
7.1 Client materials
Client-provided materials remain owned by their respective owners. The customer grants NBH Partners BPO the limited permission necessary to use those materials to perform the service.
7.2 Custom deliverables
Unless a written agreement states otherwise, final custom deliverables created specifically for the customer may be used by the customer for the agreed business purpose after all amounts due for those deliverables have been paid. Pre-existing methods, reusable code, frameworks, templates, libraries, know-how, processes, internal tools, and generic components remain the property of their existing owner or licensor.
7.3 Third-party licences
Fonts, stock media, plugins, SaaS products, APIs, themes, libraries, open-source software, payment services, hosting, domain services, marketplaces, and other third-party materials remain subject to their own licences and terms. The customer may need to purchase or maintain separate licences.
7.4 Third-party outages and policy changes
NBH Partners BPO does not control third-party platforms and is not responsible for outages, account reviews, suspensions, API changes, deprecations, pricing changes, policy changes, security incidents, or service discontinuations caused by those providers. Work required to respond to such events may be separately chargeable.
8. Strict Acceptable-Use and Prohibited-Activity Policy
NBH Partners BPO will not knowingly provide services intended to facilitate unlawful or abusive conduct. We may refuse, suspend, or terminate work involving:
- unauthorised system access, malware, ransomware, credential theft, phishing, credential stuffing, denial-of-service activity, botnet activity, or bypassing technical access controls;
- fraud, impersonation, deceptive payment activity, fabricated identities, chargeback abuse, or misleading commercial practices;
- stolen, pirated, counterfeit, defamatory, privacy-invasive, or infringing content;
- unlawful scraping, spam, unsolicited bulk messaging, or automated activity that violates applicable law or platform rules;
- instructions to hide malicious code, exfiltrate data, defeat security controls, or conceal unauthorised activity;
- content or conduct that exposes NBH Partners BPO, its personnel, or service providers to unreasonable legal, security, sanctions, payment-network, or reputational risk.
Refusal or suspension arising from the customer’s prohibited or unlawful instructions does not create a refund right for lawful work already performed, capacity already reserved, or non-recoverable costs already incurred, subject to mandatory law.
9. Service-Specific Disclaimers
9.1 Websites, software and SEO
Search rankings, traffic, conversions, platform approval, browser behaviour, third-party integrations, and commercial outcomes depend on factors outside NBH Partners BPO’s control. No specific ranking, revenue, traffic level, uptime percentage, conversion rate, platform approval, or business result is guaranteed unless an express written service-level commitment states otherwise.
9.2 BPO and operational services
BPO services provide agreed operational capacity and process execution. Sales results, lead conversion, customer retention, response volume, platform availability, and end-customer behaviour cannot be guaranteed. The customer remains responsible for business decisions, compliance rules, escalation standards, and approvals that require client authority.
9.3 Creative services
Creative work is evaluated against the agreed brief, references, specifications, and included revisions. Subjective preference changes after approval are not defects and may be treated as additional work.
9.4 Trading education and tools
Trading-related materials are educational and organisational only. They are not investment, brokerage, legal, tax, accounting, or personalised financial advice. No profit, return, trading result, or avoidance of loss is promised or guaranteed.
10. Suspension and Termination
NBH Partners BPO may pause or terminate work for non-payment, abusive conduct, repeated failure to provide required information, material breach of agreed terms, unlawful instructions, security risk, sanctions or payment-network concerns, or conduct that makes safe or lawful performance impracticable. Where appropriate, the customer will be informed of the issue and any reasonable steps required to resume work.
11. Chargebacks, Disputes and Liability
11.1 Contact us before a payment dispute
Customers should contact NBH Partners BPO promptly about a genuine billing or delivery concern before initiating a chargeback. We will investigate reasonable complaints and provide available order and delivery records.
11.2 Unjustified chargebacks
Where a chargeback or payment dispute is inconsistent with an accepted order, these policies, or documented work already performed, NBH Partners BPO may contest it using legally and contractually appropriate evidence, including checkout acceptance records, invoices, communications, project records, logs, deliverables, time records, and proof of service commencement or completion.
11.3 Limitation of liability
To the maximum extent permitted by applicable law and unless a signed agreement expressly states otherwise, NBH Partners BPO is not liable for indirect, incidental, special, punitive, or consequential loss; loss of profit, revenue, opportunity, goodwill, anticipated savings, or data; or loss caused by client instructions, client systems, third-party platforms, security incidents outside reasonable control, or events beyond reasonable control.
To the maximum extent permitted by law, aggregate liability arising from a specific paid order will not exceed the amount actually paid to NBH Partners BPO for the affected service giving rise to the claim. This limitation does not apply where applicable law prohibits such a limitation.
12. Events Outside Reasonable Control
Neither party is responsible for delay caused by events reasonably outside its control, including major internet or cloud outages, power failures, natural disasters, war, civil disruption, government restrictions, labour disruption, epidemics, payment-network failures, platform outages, cyber incidents affecting third parties, or other force-majeure events. The affected party should resume performance when reasonably practicable.
13. Mandatory Consumer and Statutory Rights
Nothing on this page removes a right or remedy that applicable law says cannot be waived. Where mandatory consumer-protection, data-protection, payment, or other law applies, that law prevails over any conflicting provision.
In particular, a service customer may have statutory withdrawal or conformity rights depending on location, customer status, the nature of the service, whether immediate performance was expressly requested, and how much of the service has already been performed. The strict non-refundable rules above apply only to the maximum extent legally permitted.
14. Policy Updates
NBH Partners BPO may update these policies to reflect changes in services, technology, operational practices, payment-provider requirements, or law. Unless required otherwise, material changes apply prospectively to future orders. The policy version accepted at checkout may be recorded with the order.
Questions about an order, billing issue, delivery issue, cancellation request, technical concern, or these policies should be submitted through the Contact page.
